My HW seems dead if the maschine software is not running and it's not in MIDI mode. I think it should be possible to emulate this after sniffing the traffic on the USB bus, and release some kind of open-source MK3 starter tool, but this has yet to be done afaik. I do not know if a license gets involved in this communication - if not then license is only needed to get the service installed - you can get it installed by other means, if you know what I mean (that's how I figured this out, while waiting for the seller to send a transfer ID to me). This service(s) is normally installed during Maschine 2 installation. To summarize - a proprietary service(s) has to run on the system which detects the device and sends commands to it to make it fully start. the special command (or commands) are sent by the special system service(s) which get installed together with Maschine 2 software (but can function without it).
